These Terms and Conditions (“Terms”) apply to your use of Jobyay (“we”, “us”, “our”) and any services we provide through it (the “Website”).
Jobyay is an online advertising platform for:
- Job listings posted by employers and recruiters (“Job Advertisers”); and
- Course and training listings posted by training providers (“Training Advertisers”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

2. Definitions
- Advertiser means a Job Advertiser or Training Advertiser.
- Listing means a job advert, course advert, or any promotional content published on the Website.
- User means anyone who visits the Website, including jobseekers and learners.
- Content means text, images, logos, videos, links, and other materials.
3. What we do (and don’t do)
3.1 Platform only
We provide advertising and publishing services for Listings. We are not:
- an employment agency or recruitment agency;
- a training provider, college, awarding body, or certification body; or
- a party to any agreement between Users and Advertisers.
3.2 No guarantee
We do not guarantee:
- that Listings are accurate, complete, up to date, or available;
- that any User will obtain a job, interview, offer, enrolment, funding, or qualification; or
- that any Advertiser will respond to an application or enquiry.
4. Using the Website
4.1 Eligibility
You must be at least 18 years old to use the Website. By using it, you confirm that you meet this requirement.
4.2 Acceptable use
You must not:
- use the Website for unlawful purposes;
- post or submit false, misleading, defamatory, or discriminatory content;
- attempt to gain unauthorised access to the Website or its systems;
- scrape, harvest, or collect data from the Website without permission;
- upload malware or do anything that could disrupt the Website.
4.3 Account security (if you provide accounts)
If you create an account, you are responsible for keeping your login details secure and for any activity under your account.
5. Listings, applications and enquiries
5.1 Applications and enquiries
When you apply for a job or enquire about a course through the Website, your information may be provided to the relevant Advertiser. Any further steps (including interviews, enrolment, payments, contracts, or funding arrangements) are between you and the Advertiser.
5.2 Advertiser responsibility
Advertisers are solely responsible for their Listings, including ensuring they are accurate, lawful, and comply with UK law (including equality and consumer protection requirements where applicable).
6. Advertiser rules
6.1 What Advertisers must ensure
Advertisers must ensure that Listings:
- are accurate, clear, and not misleading;
- include all material information Users need to understand the opportunity;
- do not include unlawful discrimination (including under the Equality Act 2010);
- do not infringe third-party rights (including intellectual property rights);
- comply with all applicable laws, regulations, and codes of practice.
6.2 Prohibited content
We may reject or remove Listings that we believe (acting reasonably) are:
- misleading, deceptive, or unclear (including “bait-and-switch” advertising);
- unlawfully discriminatory or hateful;
- adult, explicit, or inappropriate;
- illegal or promoting illegal activity;
- spam or low-quality content.
6.3 Our editorial discretion
We may edit formatting or minor details for presentation or compliance, but we do not verify the truthfulness of Listings. Advertisers remain responsible for their content.
7. Fees, billing and refunds (Advertisers)
7.1 Fees
Advertisers must pay the fees shown at the time of purchase (or as otherwise agreed in writing). Fees are payable in advance unless we agree otherwise.
7.2 VAT
Prices are inclusive of VAT (as stated at checkout or in your invoice).
7.3 Refunds
Unless required by law or expressly agreed in writing, advertising fees are non-refundable once a Listing has been published. We may offer pro-rata credits or refunds at our discretion where a technical fault on our side materially prevents publication.
8. Intellectual property
8.1 Our content
All intellectual property in the Website (excluding Advertiser content) belongs to us or our licensors. You may not copy, reproduce, or exploit it without our permission.
8.2 Advertiser content licence
By submitting content to us, Advertisers grant us a worldwide, non-exclusive, royalty-free licence to use, display, publish, and promote that content in connection with the Website and our marketing of Listings.
9. Availability and changes
We aim to keep the Website available but do not guarantee uninterrupted access. We may update, change, suspend, or withdraw any part of the Website at any time.
10. Liability
10.1 Website use
To the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of the Website, including reliance on Listings.
10.2 No exclusion for certain liabilities
Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded under UK law.
11. Indemnity (Advertisers and Users)
You agree to indemnify us against losses, claims, and costs arising from your breach of these Terms or your content (including Listings) where you are responsible.
12. Third-party links
The Website may include links to third-party websites. We are not responsible for their content, policies, or availability.
13. Termination
We may suspend or terminate access to the Website (or remove Listings) if we believe you have breached these Terms or misused the Website.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except where mandatory local consumer laws apply.
