Advertiser Terms

These Advertiser Terms apply if you purchase or submit advertising on Jobyay as an employer, recruiter, training provider, or other organisation (“Advertiser”, “you”). They sit alongside our main Terms and Conditions. If there is a conflict, these Advertiser Terms take priority for advertising matters.

 


 

1. What you are buying

We provide paid advertising services, which may include:

  • publication of job listings and/or course listings;
  • featured placement or enhanced visibility (if purchased);
  • branding, links, and calls-to-action as available in our packages.

Package details, durations, and pricing are shown at the point of purchase (or in your written agreement with us).

 


 

2. Your responsibilities

2.1 Accuracy and honesty

You must ensure your Listings and claims are accurate, clear, and not misleading, including:

  • job titles, locations, salary/compensation (where stated), and essential requirements;
  • course titles, delivery method, dates, duration, pricing/fees, entry requirements, and accreditation (where claimed);
  • any funding claims (for example, government-funded places) must be clearly explained and accurate.

2.2 Legal compliance

You must comply with all applicable UK laws and regulations, including (where relevant):

  • Equality Act 2010 (no unlawful discrimination in recruitment or marketing);
  • consumer protection law for course advertising (no misleading omissions or practices);
  • data protection law (UK GDPR and Data Protection Act 2018) when handling applications and enquiries.

2.3 Right to use content

You confirm you have all necessary rights to use any content you provide (including logos, images, trademarks, and course materials) and that it does not infringe third-party rights.

 


 

3. Applications, enquiries and user data

Users may apply or enquire through the Website or via your link(s). You are responsible for:

  • your own recruitment/enrolment process;
  • responding to Users (if you choose);
  • securely handling and processing personal data you receive;
  • providing any required privacy information to Users.

We are not responsible for your communications, decisions, vetting, hiring/enrolment outcomes, payments, refunds, or disputes with Users.

 


 

4. Our rights

4.1 Approval and removal

We may refuse, suspend, edit, or remove any Listing that (acting reasonably) we believe breaches our policies or is unlawful, misleading, discriminatory, or otherwise harmful to users or our platform.

4.2 Changes to placement

We may change the placement or formatting of Listings to improve performance, comply with legal requirements, or maintain the quality of the Website. Featured placement is not a guarantee of results.

 


 

5. Fees, invoicing and refunds

5.1 Payment

Fees are payable in advance unless otherwise agreed in writing. If you fail to pay, we may pause or remove listings.

5.2 Refunds

Advertising fees are generally non-refundable once a listing is published, except where required by law or where we agree otherwise in writing. If we remove a listing due to your breach, you will not be entitled to a refund.

 


 

6. Licence to use your content

You grant us a worldwide, non-exclusive, royalty-free licence to host, publish, reproduce, display, distribute, and promote your Listings and branding in connection with the Website and our marketing (including email, social media, and search previews) for the duration of your campaign and for a reasonable period afterwards for reporting, archiving, and fraud prevention.

 


 

7. Liability

To the maximum extent permitted by law, we are not liable for:

  • the performance of Listings or any results (applications, enrolments, hires);
  • losses arising from inaccuracies in your Listing content;
  • your interactions or disputes with Users.

Nothing excludes liability that cannot be excluded under UK law (including for fraud or death/personal injury caused by negligence).

 


 

8. Termination

We may suspend or terminate your advertising access if you breach these Advertiser Terms or our main Terms.

 


 

9. Governing law

These Advertiser Terms are governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction (subject to mandatory rules).
